• "Lesson Teacher" refers to an individual registered on our platform who provides the tutoring services.

• "Platform" refers to the online tutoring marketplace provided by Bloom Learning.
• "Personal Data" has the meaning given in the Data Protection Legislation.

By registering as a client on Bloom Learning's platform and using our services, you agree to abide by the following terms and conditions:

Definitions

• "Lesson" refers to the tutoring session or lesson you receive from Lesson Teachers on our platform.
• "Client Account" refers to the account you create on our platform to access our services.
• "Platform Credits" refers to the virtual credits that can be used for rescheduling or booking new lessons on our platform.

Client Registration and Bloom Services

2.1. You must create a Client Account on our platform to use our services.

2.2. You are responsible for providing accurate and complete information during the registration process.

2.3. You may access Bloom Learning's services once registered, including searching for available Lesson Teachers and scheduling lessons.

Client Obligations

3.1. You agree to:

• Respect Lesson Teachers and their availability.
• Attend scheduled lessons punctually.
• Use Platform Credits for rescheduling or booking lessons.
• Provide accurate feedback and ratings for Lesson Teachers.
• Abide by our Acceptable Usage Policy (Section 14 in the General Terms).

Bloom Learning Obligations

4.1. Bloom Learning is committed to:

Providing a secure platform for clients and Lesson Teachers to interact.

Ensuring Lesson Teachers meet the necessary requirements.

Facilitating payments for lessons, including processing refunds in accordance with our Cancellations and Refunds Policy.

Client Fees

5.1. You may be required to pay fees for lessons booked through our platform.

5.2. The fees will be clearly communicated to you before confirming a lesson booking.

5.3. We reserve the right to adjust our fee structure, and any changes will be communicated in advance.

Conduct and Fraud

6.1. Any form of fraudulent activity, including attempting to manipulate lesson bookings, ratings, or payments, is strictly prohibited.

Intellectual Property

7.1. Any materials provided by Lesson Teachers during lessons are for the Client’s personal use and may not be reproduced, distributed, or used for any commercial purposes without the Lesson Teacher's and Bloom Learning’s consent.

Cancellations, Rescheduling, No-Show

8.1. Cancellations:

You may cancel a lesson up to 48 hours before the scheduled start time. Cancellations within 48 hours may result in no refund being provided or a reduction in the refund amount.

8.2. Rescheduling:

You may request to reschedule a lesson, subject to the Lesson Teacher's availability and agreement.

8.3. No-Show:

If you do not attend a scheduled lesson without prior cancellation, the Lesson Teacher may receive compensation, and you may receive no refund or a reduction in the refund amount.

Ratings and Feedback

9.1. You are encouraged to provide honest and constructive feedback and ratings for Lesson Teachers after each lesson.

Data Protection and Privacy

10.1. For your privacy and security, all communication between you and Lesson Teachers must occur exclusively through the platform. Sharing personal contact information is prohibited.

Disputes

11.1. In case of disputes with Lesson Teachers or other clients, you agree to follow the Dispute Resolution Process outlined in Section 14 of the General Terms.

Termination

12.1. You may close your Client Account at any time, subject to the terms of our Termination Policy.

Warranties and Indemnities

13.1. You represent and warrant that all information provided during registration and while using our services is accurate and truthful.

13.2. You agree to indemnify and hold Bloom Learning harmless from any claims, losses, or damages arising from your use of our platform.

Limitation of Liability

14.1. Our liability to you as a client is subject to the limitations outlined in Section 12 of the General Terms.

General

15.1. These Client Terms, in conjunction with the General Terms, constitute the entire agreement between you and Bloom Learning regarding your use of our platform.

Lesson Teacher Terms

Your Agreement with Bloom Learning

By registering as a Lesson Teacher on Bloom Learning's platform and offering tutoring services, you agree to abide by the following terms and conditions:

Definitions

1.1. In these Lesson Teacher terms:

• "Tutoring Services" refers to lessons provided by Lesson Teachers on our platform.
• "Lesson Teacher Account" refers to the account you create on our platform to offer your tutoring services.
• "Lesson Schedule" refers to your availability to conduct lessons on our platform.

Becoming a Lesson Teacher

2.1. To become a Lesson Teacher on our platform, you must:

• Meet our requirements.
• Create a Lesson Teacher Account.
• Provide accurate information about your qualifications and expertise.

Lesson Teacher Obligations

3.1. As a Lesson Teacher, you agree to:

• Provide and maintain accurate information about your qualifications and experience.
• Maintain an up-to-date Lesson Schedule on the platform.
• Conduct lessons punctually and professionally.
• Respect the privacy and confidentiality of clients.
• Abide by our Acceptable Usage Policy (Section 14 in the General Terms).

Bloom Learning Obligations

4.1. Bloom Learning will:

Verify and approve Lesson Teachers based on set criteria

Facilitate payments for lessons, including processing refunds in accordance with our Cancellations and Refunds Policy.

Lesson Teacher Fees and Bloom Learning Payments

5.1. You may receive fees for lessons conducted through our platform.

5.2. The fee structure and payment details will be communicated to you during the onboarding process and are subject to change with notice.

Settlement

6.1. Payments for lessons will be processed by Bloom Learning and disbursed to Lesson Teachers in accordance with our Payment Policy.

Intellectual Property

7.1. Any materials produced by Lesson Teachers and provided to clients during lessons remain the intellectual property of Lesson Teachers. Clients may not reproduce, distribute, or use these materials for commercial purposes without the Lesson Teacher's consent.

7.2 Any materials provided to Lesson Teachers by Bloom Learning for use in lessons remain the intellectual property of Bloom Learning. Lesson Teachers may not reproduce, distribute, or use these materials for commercial purposes without Bloom Learning’s consent.

7.3. Any materials produced by Bloom Learning and provided to clients by Lesson Teachers during lessons or directly by Bloom Learning remain the intellectual property of Bloom Learning. Clients may not reproduce, distribute, or use these materials for commercial purposes without Bloom Learning’s consent.

Cancellations, Rescheduling, No-Show

8.1. Cancellations: You may cancel a lesson up to 48 hours before the scheduled start time. Cancellations result in no compensation to the Lesson Teacher.

8.2. Rescheduling: Lesson Teacher may request to reschedule a lesson up to 48 hours before the scheduled start time, subject to the Client's availability and agreement.

8.3. No-Show: In case of a client no-show without prior cancellation, the Lesson Teacher may be entitled to compensation.

Client Ratings, Feedback, and Other Activities

9.1. Clients are encouraged to provide feedback and ratings after each lesson, which may impact your reputation on the platform.

Data Protection and Privacy

10.1. All communication between you and clients must occur exclusively through the platform. Sharing personal contact information is prohibited to protect privacy and security.

Confidential Information and Publicity

11.1. You must respect the confidentiality of client information and not disclose any client-related information to third parties.

11.2. You agree that Bloom Learning may use your name, likeness, and expertise for promotional purposes on the platform.

Termination and Suspension

12.1. Bloom Learning may suspend or terminate your Lesson Teacher Account and ability to provide tutoring services on the platform in accordance with our Termination Policy.

Warranties and Indemnities

13.1. You represent and warrant that all information provided during registration and while offering your services is accurate and truthful

13.2. You agree to indemnify and hold Bloom Learning harmless from any claims, losses, or damages arising from your provision of tutoring services on our platform, including any claims related to the quality or accuracy of your services.

Limitation of Liability

14.1. Our liability to you as a Lesson Teacher is subject to the limitations outlined in Section 12 of the General Terms.

Disputes

15.1. In case of disputes with clients or other Lesson Teachers, you agree to follow the Dispute Resolution Process outlined in Section 14 of the General Terms.

16.1. These Lesson Teacher Terms, in conjunction with the General Terms, constitute the entire agreement between you and Bloom Learning regarding your provision of tutoring services on our platform.
